Question

The High Court of Lahore has decreed that a marriage during the Iddat is not baatil (invalid), and that the couple marrying during the woman's Iddat cannot be charged with zina. Is this correct according to the Shariah?

Answer

The Lahore High Court is not a Shariah court. It is a court which operates according to kufr law. Pakistan is not a country governed by the Shariah. Nikah during Iddat is not valid. However, it is correct that the couple cannot be charged with the crime of zina. This is because of the lack of Shar'i evidence for proving zina. Furthermore, those who believe that Nikah during Iddat is valid become kaafir. They lose their Imaan.
