Question
A student studying at a Madrasah told a boy and girl who had entered into a secret marriage that it is permissible for them to engage in sexual relations during the wife's menses if the husband feared committing zina. They accepted the student's fatwa and acted accordingly. Did they commit kufr?
Answer
The statement made by the 'friend' studying at a Madrasah is satanic. He is a jaahil propagating shaitaaniyat. It is not permissible for the husband to even look at the bared part of his wife from the navel to the knees during her haidh.
All three characters in this haraam episode are guilty of kabeerah sins. However, the boy and the girl have been misled by the jaahil student, hence their commission of the sin is not kufr. If the jaahil had issued his corrupt 'fatwa' on the basis of a genuine misunderstanding, then he too is not guilty of kufr. But, if he gave the satanic advice whilst being aware that it is haraam, then he has committed kufr and has to make taubah and renew his Imaan.
