Question
A baalighah girl did not want to marry the boy who had proposed for her. However, her father was adamant that she should get married to him. Although she had refused, her father went ahead with the Nikah. When permission was sought from her, she cried. Was the Nikah valid?
Answer
Since the girl had clearly informed her father that she does not want to marry the boy, her crying was not consent. In the background of her refusal, and abstention from verbal acceptance, her crying signified refusal. As such the Nikah is not valid.
