Question
There are no pathways in our qabrustaan. When we go to bury someone, we are forced to walk on top of the graves. There is no other option. What is the Shariah's ruling in this situation?
Answer
The people are guilty of gross carelessness and indifference for burying in such an unsystematic manner that leaves no walking path in the qabrustaan (graveyard). In the circumstances there is no option but to walk over the graves and make Taubah and regret the sin. The lesser of the evils is to walk over the graves in order to bury the mayyit.
