A father took permission from his daughter to have her Nikah performed, but there were no witnesses to listen to the daughter giving consent.

Question

A father took permission from his daughter to have her Nikah performed, but there were no witnesses to listen to the daughter giving consent. Then with the father's permission the Nikah was performed in the Musjid. Is the Nikah valid?

Answer

The Nikah is valid even if there were no witnesses to the girl's consent. The father's presence at the Nikah ceremony sufficed. The validity of the Nikah is not dependent on witnesses at the time of obtaining the girl's consent.
