Question
According to some of our Akaabir Ulama, while nikah with a Shiah woman is valid, nikah with a Shiah male is not valid. They say that despite Shiahs being kaafir, they are like the Ahl-e-Kitaab. A Muslim male‟s nikah with a Kitaabi woman is valid, not the Muslim woman‟s nikah with a Kitaabi. Is this correct?
Answer
It is not correct. The Akaabir have erred in this matter. That Shiahs are Ahl-e-Kitaab is a mistaken notion. The Ahle-Kitaab (Yahood and Nasaara) believe in their scriptures (Tauraah and Injeel). Notwithstanding the corrupted versions, they are still regarded as Ahl-e-Kitaab in terms of explicit Qur‟aanic verses. But Shiahs have no Kitaab, not even a corrupted version. According to Shiahs the Qur‟aan is a fabrication of the Sahaabah. Thus, they reject the entire Qur‟aan. Therefore they are Kitaabless. Thus the classification of Ahl-e-Kitaab for them is erroneous.
