Question
A husband is a homosexual. He does not sleep with his wife. He indulges in homosexuality with men. The wife wants Talaaq, but he refuses. What should she do? Is her marriage still valid?
Answer
Despite the evils of the man and living apart from his wife, the marriage remains valid. If he refuses to issue Talaaq, she should apply to the Ulama Council for annulment of her marriage.
