The wife left the marital home because she wanted a separate apartment. She refused to live with her in-laws. She went back to her parents home without the permission of her husband. Is the husband liable for her nafqah (expenses)? She refuses to return to the house which is occupied by her in-laws.
Answer
A separate apartment is her right. Since the husband has failed to provide separate accommodation, she is entitled to maintenance even if she has left his house without his permission.
