Nikah (Marriage) - Talaaq (Divorce) The Majlis Vol 27 No 01, p.4

Does a separation of many years invalidate the Nikah?

Question

Does a separation of many years invalidate the Nikah?

Answer

Even a separation of a lifetime does not invalidate the Nikah. The Nikah remains valid and the wife will inherit in her husband's estate even if she commits adultery. A man should not seek to punish his wife by withholding Talaaq if she refuses to live with him. In the long term he punishes himself.
