Question

I have been informed that Qadha fasts will be valid only if the niyyat is made before Subh Saadiq. I have fasted Qadha for years without making such niyyat before Subh Saadiq. Do I have to repeat all the fasts?

Answer

When you began fasting, surely you must have had the intention of Qadha when you got up for Sehri and had some food. You knew what you were doing. You did not get up before Subh Saadiq to have your normal breakfast. You got out of your bed and had some food for a specific reason. Thus you participated in Sehri before Subh Saadiq with the intention of fasting. The validity of intention does not require verbal recitation of the niyyat. The intention in the mind suffices. Therefore, there is no need to repeat the Fasts.
