Question
My estranged wife who has left me is incapable of looking after the minor children. She went to her mother's home with the children. Islamically will I have the right of custody seeing that she is unfit?
Answer
If the children's mother is incapable of caring properly for the children, then it will be the right of the maternal grandmother to have custody of the children. If the maternal grandmother is unable to fulfil her obligation, then it will be the right of the paternal grandmother.
