Nikah (Marriage) - Talaaq (Divorce) The Majlis Vol 23 No 08, p.4

A married non-Muslim woman embraced Islam, but not her husband.

Question

A married non-Muslim woman embraced Islam, but not her husband. Soon thereafter a Muslim married her. The husband did not divorce her. What is the position of the Nikah to the Muslim man?

Answer

The non-Muslim woman who accepted Islam was supposed to wait out the Iddat of three Haidh periods. Only thereafter would marriage be permissible. If this was not done, then they should separate and after expiry of the Iddat perform Nikah.
