Question
A man had two wives. From the first wife he had 1 son and 3 daughters. From the second wife he had 2 sons and 2 daughters. Some unmarried daughter from the first wife has passed away. She left behind jewellery. How should her assets be divided according to the Shariah? A Mufti said that the jewellery goes to only the first wife's children. Was he right?
Answer
We have understood that when the daughter passed away, both her parents were not alive. Both had passed away before her. If this is so, then her heirs are only her one full brother and her two full sisters. Her half-brothers and sisters do not inherit. The jewellery and all her assets should be divided into four equal shares. The brother receives two shares, and each sister one share. The Mufti was right.
