A Shaafi Aalim issued a faskh, annulling a marriage without calling the husband to the hearing. On the story of the woman alone, he annulled the Nikah. Is the faskh valid?
Answer
The 'faskh' issued by the Shaafi in the manner described by you is null and void. The Nikah remains valid. The woman remains in her husband's Nikah.
