Question
The deceased is survived by his pregnant wife, mother, and father. How should his estate be distributed?
Answer
The unborn child must be assumed to be a boy. Thus, the estate will be divided into 24 shares and the distribution will be as follows:
Father 4, Mother 4, Wife, 3 and the balance of 13 shares will be for the unborn baby assumed to be a boy. The brothers do not inherit in this case.
If the child is a girl, the distribution of the 24 shares will have to be re-arranged as follows:
Father 5, Mother 4, Wife 3, and daughter 12.
