Death and Wills The Majlis Vol 22 No 12, p.3

The deceased's only relatives are his wife, 3 sons and 2 daughters.

Question

The deceased's only relatives are his wife, 3 sons and 2 daughters. The one son occupied the house for years without paying rent. It has now been decided to wind up the estate. Does the son have to pay rent for all the years he has lived in the house?

Answer

His estate has to be compulsorily divided into 64 equal shares and awarded to the heirs as follows: Wife receives 8 shares; each son 14 and each daughter 7 shares. No rental may be claimed from the eldest son because no such agreement had been made. It is compulsory to share the property in the manner we have explained above.
