Nikah (Marriage) - Talaaq (Divorce) The Majlis Vol 21 No 11, p.4

A husband says to his wife: 'I want to divorce you.' Is this a valid Talaaq?

Question

A husband says to his wife: 'I want to divorce you.' Is this a valid Talaaq?

Answer

If a man says verbally: 'I want to divorce you", Talaaq does not come into effect because he said "I want to...". But if he says verbally even if he is alone: "I divorce my wife", then one Talaaq Raj'i comes into effect. Before expiry of her iddat he can take her back without the need to perform Nikah.
