Just as MPL and MMB were Kufr, so too is Al Jama’s ‘Nikah’ bill, henceforth referred to as KNB (Kufr Nikah Bill).
Just as Muslims had objected to the Kufr MPL and MMB bills, so too has it become incumbent to lodge objections to the government against the KNB which is in total conflict with the Shariah.
All Muslims are urged to lodge their objections to the Speaker of Parliament. E-mail your objection to: [email protected]
Muslim individuals and organizations are required to immediately write to the Speaker of Parliament objecting to the KNB. State in your own words your objection. A brief letter will suffice. Attached is our objection.
State your opposition/dissociation. Mention that the bill is in conflict with the Shariah and that Al Jama ah has no mandate from the Ulama and the Muslim community to speak on its behalf and to even submit a bill which is abhorrent to Islam and the Muslim community.

RE:MARRIAGE & DIVORCE BILLS PROPOSED

The Mujlisul Ulama of S.A. as well as numerous other Islamic organizations of Ulama and laymen are in vehement opposition to the Marriage & Divorce bills which have been introduced by MP M.G.Hendricks.
The vast majority of the Muslim community rejects these bills which are in conflict with our religious laws. The bills introduced by Mr.Hendricks are of the same strain as the now discarded MPL and MMB (Muslim Marriages Bill).
Muslims are satisfied with the law as it stands. The case brought by Jama-ah Party in support of its bills is the imagination of Mr.Hendricks. The ‘hardships’ for Muslims as a result of legal non-recognition of Muslim marriages are hallucinatory figments which are devoid of the substance of reality.
Muslims opt volitionally to refrain from seeking legal recognition in view of the fact that the consequences of legal recognition militate gravely against the provisions of the Shariah (Islamic Law) as applicable to marriages, divorces, maintenance, etc.
The fundamental basis for Mr.Hendricks introducing his bills is his cliché of the terms “NEVER MARRIED”, which are stated on the death certificates of Muslims. To rectify this abominablity there is no need for cumbersome and silly bills to be promulgated as law. The simple solution is for the government to instruct its home affairs department to refrain from the offensive terms and to substitute it with “Muslim Rites”. So, instead of “Never Married” recorded on the death certificates, the phrase “Muslim Rites” should appear. There can be no infringement of any law Act if the terms “Muslim Rites” appear on death certificates.
Our demand is that the bills be withdrawn and scrapped.
