BAATIL ACQUISITION OF A CHURCH BUILDING

The City Press, dated 15 April 2012 reported that the Muslim community has purchased a Dutch reformed Church building in one of Johannesburg’s suburbs. The church will most probably be converted into a Musjid. The paper reports that it will be converted into a ‘Muslim school’.

Among the conditions of the sale are the following:

(1) The historical nature of the church building has to be preserved and respected. (2) The graves have to be protected. (3) Interested parties will have access to the site.

The Muslim community of the area is hereby informed that the sale is invalid in terms of the Shariah. The conditions attached to the sale are from the Shariah’s perspective baatil and haraam. All three conditions are in conflict with the Shariah and may not be honoured.

If these conditions are not waived, the sale should be cancelled.
