Is it permissible for Hanafis to perform Witr in Ramadhaan behind the imaams in the Haramain? They perform Witr 2 raka‟ts and 1 raka‟t separately. According to some Muftis. It is permissible. They base their fatwa on a weak Hanafi opinion - the opinion of Abu Bakr Jassaas. They justify adoption of this weak view because of the dharoorah (dire need). Is this valid?
Answer
It is not at all valid. Deviating from the Math-hab on the basis of a weak, solitary view for no real reason is not permissible. The dharoorah claim in this regard is baseless. It is the figment of the imagination of the muftis. There is absolutely no need no dharoorah - for the deviation from the Math-hab permitted by some Muftis.
The Juhala (ignoramuses) have defiled the sanctity of the Two Musjids of the Haramain. The environment inside these Musjids appears to be that of a ‗marketplace'. The noise and movement are continuous disturbances. During Taraaweeh people walk between the saffs without any compunction. From after four rak'ats the movement is satanically disturbing. Musallis simply abandon the Salaat and move. Walking between the saffs is a norm in the Musjids.
Thus, there is no difficulty to separate oneself after Taraaweeh to perform Salaat alone. The remaining raka'ts plus Witr can easily be performed alone after the Imaam completes his raka't Bid'ah taraaweeh. The argument of the muftis is thus baseless and may not be adopted.
