A Muslim employer does not adhere to the government‟s laws pertaining to employees.

Question

A Muslim employer does not adhere to the government‟s laws pertaining to employees. He has his own conditions and terms which employees have to abide to. The benefits in legal contracts are not included in his agreement with his workers. Is this permissible? What about a pension fund? Can employees complain to the authorities?

Answer

According to the Shariah, there has to be an agreement between the employer and employee. Work times, kind of work and salary must be defined and specified. Whatever terms have been mutually agreed are binding on the parties.

However, if the terms are exploitive, and employers taking advantage of circumstances, perpetrate exploitation, they will be guilty of transgression and sin.

The employee is entitled to the benefits agreed on. The laws of the government in this regard are not binding.

Leave, holidays and the like have to be stipulated in the agreement and mutually agreed on. If the agreement does not provide for such benefits, the employee will not have the right to demand benefits.

It has become quite common for the womenfolk of ulema and pious homes, who observe strict parda, to adorn themselves with thick layers of makeup according to western styles (not just a dab of lipstick or powder) when attending walimas. These functions have strict pardah and there are no males present.

The makeup takes a long time to apply as there are different products that are layered. Many women have make-up artists to apply it for them. The makeup costs a lot of money. If one's wudhu breaks, one has to wash all the makeup off before making a fresh wudhu.

These womenfolk of ulema and pious homes, who are normally in strict pardah, are wearing dresses under their abayas and removing the abayas at the functions. These dresses are either sewn or imported from Turkey or Arab countries. The dresses are long and long sleeves but are extremely tight- fitting. High heel shoes are worn. These womenfolk then cannot sit on the floor and eat due to their clothing.

3.How is a muslima supposed to dress when they attend a walima/function where there are no males present?

Answers

1) Dressing in the manner described by you, then attending functions is haraam. Such women are described as ‗prostitutes' in the Hadith. 2) It is haraam to wear makeup when attending functions. Aggravating the hurmat is that most of this shaitaani make-up stuff contain haraam ingredients.

3) Firstly, it is not permissible for females to attend walimas just as it is not permissible to attend Musjids. Thus their attendance itself is proscribed even without adorning themselves like prostitutes.

If the employees have agreed to the conditions of the agreement, then it will not be permissible for them to complain to the authorities if the employer does not abide by the law of the land.
