Death and Wills The Majlis Vol 28 No 06, p.2

The deceased is survived by only two daughters.

Question

The deceased is survived by only two daughters. One daughter married a Christian in the church according to the Christian faith. What is her status with regard to inheritance?

Answer

The fact that the woman married in terms of the Christian faith renders her a Murtaddah. She is not a Muslim. As such she inherits nothing. The only other daughter receives the entire estate. However, if the deceased woman had brothers, or brother's sons or a husband, then they too will inherit.
