Question
Is the following view correct? "If the stored image (or recording) is in an electronic medium such as a laptop, phone or memory card it is not considered „Tasweer‟ as mentioned In the narrations of Nabi (Sallallaho Alaihe Wassallam)." In support of this view, they quote Sheikh Abdul Fattah Abu Gudda who was a prominent Hanafi scholar and others.
Answer
An image regardless of it being hidden or stored in any device remains a picture. If such an image is that of an animate object, it is the very Tasweer vehemently prohibited by Rasulullah (Sallallahu alayhi wasallam), and for which extremely severe punishment has been decreed by Allah Ta'ala.
The fact that the stored image can be immediately reproduced and displayed on a surface is adequate for the understanding of any person. He will understand from the displayed image that it is a picture, not a reflection as morons claim.
The method of producing the picture is of no concern. The method whether it be modern, scientific and primitive is not the target of the prohibition. The actual picture if of an animate object is haraam.
The argument stated in the question is skulduggery which is used to halaalize something which is glaringly haraam and so extremely simple to understand.
We do not follow Shaikh Abdul Fattah Ghudda. He has clearly erred in his view pertaining to photography. He was influenced by liberalism. That is why he travelled around with a camera slung over his shoulder. This is the style of non-Muslims. We follow the Shariah. Regardless of the status of an Aalim, Shaikh or Buzrug, his views and statements are viewed in the light of the Shariah.
Pictures of animate objects are haraam regardless of the method of production.
