If a loan is given to someone who asks for the money to be transferred into his banking account, who has to pay the bank fee?

Question

If a loan is given to someone who asks for the money to be transferred into his banking account, who has to pay the bank fee? A Mufti says that the one who gives the loan has to pay the bank fee.

Answer

The bank charge has to be paid by the debtor. He asked for the loan, hence he has to pay the fee for getting the loan to reach him. If for example, Zaid asks Bakr for a loan, and Bakr says come fetch the money from my shop, then the taxi fare Zaid will incur to get the money is his (Zaid's) liability. Zaid cannot ask Bakr to pay this expense.
