Question
One partner is medically incapacitated. He suffers from a mental disease, hence is unable to make decisions or participate in the business. He has an adult son. Does this son assume the position of his father in the company?
Answer
In view of the incapacity of the father (one of the partners), his son should become the curator of his father and act in his stead.
