In some prisons in the U.S.A. Muslim prisoners charge non-Muslim inmates a fee to protect them against gangsters.

Question

In some prisons in the U.S.A. Muslim prisoners charge non-Muslim inmates a fee to protect them against gangsters. They justify it on the basis of Jizyah. Is this fee permissible?

Answer

It is haraam to charge non-Muslims a fee to protect them. This fee is extortion. It is 'protection tax' which gangsters extract from the weak. Jizyah applies only in an Islamic state. Only the Islamic Ruler has the right to levy the Jizyah tax.
